RETURN, REFUND & CANCELLATION POLICY

Effective Date: 16 September 2026

This Return, Refund and Cancellation Policy applies to purchases made from The Morning Shuffle (Pty) Ltd (“The Morning Shuffle”, “we”, “us” or “our”) through www.themorningshufflesa.co.za.

This Policy must be read together with our Terms and Conditions, Shipping Policy and Privacy Policy.

The Morning Shuffle operates in the Republic of South Africa. This Policy is intended to comply with applicable South African law, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).

Nothing in this Policy is intended to exclude, restrict or waive any consumer right that may not lawfully be excluded, restricted or waived.

1. ONLINE PURCHASES AND COOLING-OFF RIGHTS

Where section 44 of ECTA applies to an online transaction, a consumer may cancel the transaction without giving a reason and without penalty within seven (7) days after receiving the goods.

Where a customer validly exercises this right:

• The Morning Shuffle must be notified within seven (7) days after receipt of the goods.

• The customer is responsible for the direct cost of returning the goods.

• The customer must take reasonable care of the goods while they are in their possession.

• All parts, accessories and components originally supplied with the product should be returned.

• Goods must be packaged appropriately to prevent damage during return transport.

Where payment has already been made, the customer will receive the refund required by law within the applicable statutory period.

2. NO ADDITIONAL GENERAL CHANGE-OF-MIND POLICY

Except where South African law grants the customer a right to cancel or return a transaction, The Morning Shuffle does not offer an additional general change-of-mind refund or return policy.

Accordingly, once any applicable statutory cancellation or cooling-off period has expired, we are not obliged to accept a return merely because:

• the customer has changed their mind;

• the customer no longer wants or needs the product;

• the customer subsequently finds the product or a similar product elsewhere at a lower price;

• the customer selected the incorrect product, size, colour, capacity or quantity where the relevant information was reasonably available before checkout;

• the product does not suit the customer's personal preference; or

• the customer's circumstances have changed after placing the order.

This section does not affect rights relating to defective, unsafe, incorrectly supplied or otherwise non-compliant goods.

3. EXCEPTIONS TO COOLING-OFF RIGHTS

The ECTA cooling-off right does not apply to every type of transaction.

Any exclusion or limitation provided for by ECTA or other applicable South African legislation will apply where relevant.

This may include certain goods that:

• are made to the customer's specifications;

• are clearly personalised;

• by their nature cannot reasonably be returned;

• deteriorate or expire rapidly; or

• otherwise fall within a statutory exclusion.

Where goods are sealed or supplied for legitimate health, hygiene or safety reasons, a change-of-mind return after opening or use may be declined only to the extent permitted by applicable law.

This may be relevant to certain drinking, hydration, first-aid or other hygiene-sensitive products.

Nothing in this section affects rights relating to goods that are defective, unsafe, incorrectly supplied or otherwise fail to comply with applicable law.

4. DEFECTIVE, UNSAFE OR POOR-QUALITY GOODS

Products supplied by The Morning Shuffle are subject to the applicable implied warranty of quality under the CPA.

Where applicable, goods must be:

• reasonably suitable for the purposes for which they are generally intended;

• of good quality;

• in good working order;

• free of defects;

• reasonably durable having regard to their nature and intended use; and

• compliant with applicable legal standards.

Where goods fail to meet the requirements contemplated by sections 55 and 56 of the CPA within six (6) months after delivery, the consumer may return qualifying goods without penalty and at the supplier's risk and expense.

Where section 56 applies, the consumer may direct that the goods be:

• repaired;

• replaced; or

• refunded.

The Morning Shuffle will not substitute compulsory store credit for a statutory refund unless the customer voluntarily agrees to accept store credit.

5. GOODS THAT FAIL AFTER REPAIR

Where goods are repaired pursuant to the CPA and, within three (3) months after the repair:

• the original defect has not been remedied; or

• a further failure, defect or unsafe feature is discovered,

the remedies prescribed by section 56(3) of the CPA will apply.

Where applicable, the customer may be entitled to replacement of the goods or a refund of the purchase price.

6. WHAT DOES NOT ORDINARILY CONSTITUTE A DEFECT

A defect claim does not ordinarily cover damage or failure caused after delivery by:

• misuse;

• abuse;

• negligence;

• accidental damage;

• improper storage;

• incorrect installation;

• failure to follow instructions;

• use for a purpose for which the product was not intended;

• unauthorised modifications;

• alterations;

• repairs attempted by the customer or an unauthorised third party;

• punctures or damage caused by sharp objects;

• abnormal exposure to heat, chemicals, weather or other conditions for which the product was not designed;

• normal deterioration arising from ordinary use; or

• ordinary wear and tear.

For example, a hydration product punctured by a sharp object, equipment physically damaged through misuse or a repair product used on an incompatible surface will not automatically constitute a manufacturing defect.

Nothing in this provision permits The Morning Shuffle to classify a genuine inherent defect as misuse or wear and tear merely to avoid obligations imposed by law.

7. INSPECTION OF ALLEGEDLY DEFECTIVE GOODS

When a defect is reported, The Morning Shuffle may reasonably request information necessary to assess the claim, including:

• the customer's order number;

• proof of purchase;

• photographs;

• video footage;

• photographs of the packaging;

• a description of the alleged defect;

• information concerning how the product was used; and/or

• return of the product for inspection.

The purpose of an inspection is to establish, amongst other things:

• whether the product was supplied by The Morning Shuffle;

• the nature of the alleged defect;

• whether the defect is inherent;

• whether damage arose after delivery;

• whether misuse, alteration or accidental damage occurred; and

• which legal remedy, if any, applies.

An inspection does not remove or reduce any statutory right the customer may have.

8. INCORRECT PRODUCTS SUPPLIED

If The Morning Shuffle supplies a product that materially differs from the product ordered, the customer should notify us as soon as reasonably possible.

Where the customer has a statutory right to return incorrectly supplied goods, the return will be handled at our risk and expense to the extent required by law.

Once the matter has been verified, the appropriate remedy will be provided.

9. GOODS PURCHASED FOR A PARTICULAR PURPOSE

Where a customer specifically informs The Morning Shuffle before purchasing that goods are required for a particular purpose, and reasonably relies on our advice that the product will be suitable for that purpose, additional rights may arise under the CPA.

General marketing descriptions and photographs do not constitute a guarantee that a product will be suitable for every specialised, unusual or individual purpose.

Customers who require a product for an unusual or specialised purpose should contact us before purchasing.

10. GOODS DAMAGED DURING DELIVERY

Customers should inspect their parcels as soon as reasonably possible after delivery.

If a parcel or product appears to have been damaged during transportation, please contact The Morning Shuffle as soon as possible.

To assist with courier investigations, we recommend that transit damage be reported within 48 hours of delivery where reasonably possible.

We may request photographs showing:

• the outer courier packaging;

• the courier label;

• the internal packaging;

• the damaged item; and

• all items received in the parcel.

Customers should retain the packaging until advised that it may be discarded.

The 48-hour request exists to assist with evidence and courier investigations. It does not extinguish a statutory right merely because notification occurs later.

11. KITS AND BUNDLES

The Morning Shuffle sells certain products as complete kits or bundles, including:

• The Run Ready Kit;

• The Ride Ready Kit;

• The Hike Ready Kit; and

• The Coach Ready Kit.

Where a complete kit is validly returned for a full refund, all items, components and accessories supplied as part of that kit must ordinarily be returned.

A customer may not retain selected items forming part of a kit while claiming a refund for the entire kit.

Where an item forming part of a kit is missing, damaged, materially altered or used beyond what is reasonably necessary for inspection, The Morning Shuffle reserves the right to exercise any remedy or make any deduction permitted by law.

This provision does not prevent a customer from exercising a statutory right relating to an individual defective component.

12. CONDITION OF CHANGE-OF-MIND RETURNS

Where goods are returned solely because of a lawful cancellation or change of mind, rather than because of a defect, customers must take reasonable care of the goods.

Where reasonably possible, goods should be returned:

• unused except to the extent reasonably necessary to inspect them;

• with all parts and accessories;

• with original labels and tags;

• with manuals or instructions;

• in the original packaging where reasonably possible; and

• securely packaged for transport.

Where applicable law allows a reasonable charge or deduction because goods have been used, consumed, damaged, altered or require restoration, The Morning Shuffle reserves the right to impose such lawful charge.

No charge will be imposed where prohibited by law.

13. HYGIENE-SENSITIVE AND FIRST-AID PRODUCTS

Some Morning Shuffle products may involve contact with:

• drinking water;

• the mouth;

• food;

• skin;

• wounds; or

• other hygiene-sensitive applications.

For change-of-mind returns, The Morning Shuffle reserves the right to refuse opened or used hygiene-sensitive goods where applicable law permits such refusal.

This may include, depending on the product and applicable legal requirements:

• hydration bladders;

• squeeze bottles;

• drinking products;

• wound closure products;

• first-aid products; and

• other sealed hygiene-sensitive products.

This provision does not affect a customer's statutory rights where such goods are defective, unsafe, incorrectly supplied or otherwise non-compliant.

14. SALE, DISCOUNTED AND PROMOTIONAL ITEMS

Products purchased on sale, at a discount or as part of a promotion remain subject to applicable statutory consumer rights.

A discounted price does not remove rights relating to genuinely defective goods.

However, a sale or promotional product does not automatically qualify for an additional voluntary change-of-mind return where no statutory return right exists.

15. RETURN DELIVERY COSTS

Responsibility for the cost of returning goods depends on the reason for the return.

For a qualifying ECTA seven-day cooling-off cancellation, the customer is responsible for the direct cost of returning the goods.

Where goods validly qualify for return under the CPA because they are defective, unsafe or fail to satisfy the applicable statutory standards, the return will be at the supplier's risk and expense as required by law.

Where The Morning Shuffle supplied an incorrect product or another legal provision places responsibility for return costs on us, we will bear the reasonable return costs as required by law.

Customers should contact us before arranging an unusually expensive courier service where a reasonable alternative is available.

16. DELIVERY INFORMATION PROVIDED BY THE CUSTOMER

Customers are responsible for ensuring that all delivery information supplied at checkout is complete and accurate.

Where delivery fails because a customer supplied:

• an incorrect address;

• an incomplete address;

• an incorrect telephone number;

• an incorrect recipient name; or

• other materially incorrect delivery information,

The Morning Shuffle may require payment of reasonable additional delivery or re-delivery charges before sending the parcel again, to the extent permitted by law.

This section does not apply where the delivery error was caused by The Morning Shuffle.

17. UNCLAIMED OR REFUSED PARCELS

Where a parcel is returned to The Morning Shuffle because:

• the customer failed to collect it;

• reasonable delivery attempts failed because the recipient was unavailable;

• the customer refused delivery without a lawful basis; or

• circumstances attributable to the customer prevented delivery,

the customer may be responsible for reasonable return and re-delivery costs to the extent permitted by law.

This does not apply where the customer is legally entitled to reject or return the goods at our expense.

18. DELIVERY PERIOD

Our standard fulfilment information currently provides for approximately 8–12 business days for processing, preparation and delivery, unless otherwise stated on the relevant product page or at checkout.

Delivery dates are estimates unless expressly agreed otherwise.

Where applicable law entitles the consumer to cancel because an order has not been performed within the required or agreed period, those statutory rights remain unaffected.

Where an ordered product becomes unavailable, The Morning Shuffle will notify the customer and provide any refund required by applicable law.

19. CANCELLING AN ORDER BEFORE DISPATCH

Customers wishing to cancel an order before dispatch should contact us immediately.

Where we are able to stop an order before it has entered the dispatch process, the cancellation will be dealt with in accordance with applicable law.

Sending a cancellation request does not automatically mean that an order has been cancelled where it has already been processed or handed to the courier.

Where goods have already been dispatched, the applicable statutory cancellation and return provisions will apply.

20. REFUNDS

Approved refunds will generally be returned using the original payment method used to make the purchase, unless another arrangement is agreed or required by law.

Once a refund has been processed by The Morning Shuffle, the customer's bank or payment service provider may require additional processing time before the amount reflects.

Processing delays caused solely by banks or payment providers are outside The Morning Shuffle's direct control.

Where legislation prescribes a particular refund period, The Morning Shuffle will comply with that period.

21. SHIPPING CHARGES

Where a refund or cancellation is subject to legislation requiring a full refund, The Morning Shuffle will refund all amounts required by that legislation.

In circumstances where no statutory obligation to refund original delivery charges exists, delivery charges that have already been incurred may be non-refundable to the extent permitted by law.

22. PROOF OF PURCHASE

To assist us in processing a return, customers should provide:

• their order number;

• full name;

• contact information;

• date of purchase;

• identification of the product concerned; and

• the reason for the return.

The Morning Shuffle may require reasonable evidence that the goods were purchased from us.

The loss of an email receipt will not automatically eliminate a statutory claim where the transaction can reasonably be verified through our records or another satisfactory form of proof.

23. RETURN AUTHORISATION

Customers should contact The Morning Shuffle before returning goods.

We will provide, where applicable:

• return instructions;

• the relevant return address;

• a return reference; and

• information regarding courier arrangements.

Goods sent to an incorrect address or without sufficient identifying information may result in delays.

Failure to obtain prior return authorisation does not extinguish any statutory right that otherwise exists.

24. FRAUDULENT OR ABUSIVE RETURN CLAIMS

The Morning Shuffle reserves the right to investigate circumstances reasonably indicating fraud, attempted fraud or abuse of the returns process.

This includes, without limitation:

• falsified proof of purchase;

• deliberately damaged goods;

• substitution of products;

• returning goods not purchased from The Morning Shuffle;

• knowingly making false claims concerning product condition;

• deliberately removing components of kits before attempting a return;

• fraudulent delivery claims; and

• manipulation or abuse of refund procedures.

The Morning Shuffle reserves all rights available under law where fraudulent conduct is identified.

Nothing in this section permits us to reject a genuine statutory claim.

25. GOODWILL REFUNDS OR EXCHANGES

The Morning Shuffle may, at its discretion and where no statutory obligation exists, occasionally offer:

• a goodwill refund;

• an exchange;

• a replacement;

• store credit; or

• another reasonable accommodation.

A goodwill accommodation does not:

• constitute an admission of liability;

• amend this Policy;

• create a precedent; or

• oblige The Morning Shuffle to provide the same accommodation in another matter.

This section does not apply where the customer is exercising a statutory right.

26. SPORT, FITNESS AND OUTDOOR PRODUCTS

Some products sold by The Morning Shuffle are intended for activities including:

• running;

• walking;

• cycling;

• hiking;

• training;

• fitness;

• travel;

• camping; and

• outdoor recreation.

Customers are responsible for using products:

• for their intended purpose;

• in accordance with supplied instructions;

• with reasonable care;

• within their own abilities and circumstances; and

• together with appropriate safety equipment where relevant.

The purchase or use of a product does not mean that the inherent risks associated with sporting, cycling, hiking, training or outdoor activities have been eliminated.

Nothing in this section limits liability where applicable South African law prohibits such limitation.

27. PRODUCT-SPECIFIC SAFETY INFORMATION

Where applicable, customers must take note of the following:

Carabiners

Carabiners sold as general accessory products must not be used for climbing, fall protection, life support or other safety-critical applications unless the particular product is expressly certified and supplied for that purpose.

Water Filters

Outdoor water filtration products must be used strictly in accordance with the relevant instructions.

No water filtration product should be assumed to make every possible water source safe for consumption.

Wound Closure Strips

Emergency wound closure strips are intended only for minor superficial cuts.

They are not a substitute for professional medical treatment for serious, deep, contaminated, infected or heavily bleeding wounds.

TPU Repair Patches

TPU repair patches are intended for minor repairs on compatible materials.

They must not be relied on for structural, load-bearing, life-support or other safety-critical repairs.

Reusable Ice Packs

Reusable cooling packs must not be consumed.

They should be protected from puncture, sharp objects and inappropriate use.

These warnings do not remove statutory rights arising from genuinely defective or unsafe goods.

29. CUSTOMER'S STATUTORY RIGHTS

Nothing contained in this Policy is intended to:

• exclude any right or remedy granted to a consumer by applicable South African law;

• exclude or limit an obligation where doing so is prohibited by law;

• require a consumer to waive a right that cannot lawfully be waived; or

• prevent a consumer from approaching a competent regulator, ombud, tribunal or court where legally entitled to do so.

If any provision of this Policy conflicts with a mandatory provision of applicable South African legislation, the legislation will prevail and the remaining provisions of this Policy will continue to apply to the extent permitted by law.

30. GOVERNING LAW

This Policy and transactions concluded through The Morning Shuffle are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with subject to applicable consumer legislation and the jurisdiction of any court, tribunal, regulator, ombud or dispute-resolution body having lawful jurisdiction.

31. CHANGES TO THIS POLICY

The Morning Shuffle may amend this Policy from time to time to reflect changes to:

• our business;

• our products;

• our fulfilment processes; or

• applicable legislation.

The version applicable to an order will generally be the version in force when the transaction was concluded, subject to any mandatory rights provided by law.
