The Morning Shuffle operates an online retail business supplying products relating to running, cycling, hiking, training, fitness, travel, outdoor activity and related uses.
2. APPLICABLE LAW
These Terms are governed by the laws of the Republic of South Africa.
Our transactions are subject, where applicable, to legislation including:
• the Consumer Protection Act 68 of 2008 (“CPA”);
• the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”);
• the Protection of Personal Information Act 4 of 2013 (“POPIA”); and
• other applicable South African legislation.
Nothing in these Terms overrides any mandatory statutory protection available to a consumer.
3. ELIGIBILITY AND LEGAL CAPACITY
By placing an order, you confirm that you have the legal capacity to enter into a binding transaction.
If you are under the age of legal majority or otherwise lack full contractual capacity, you must use this website and make purchases only with the involvement and consent of your parent, legal guardian or other person legally authorised to act on your behalf.
You are responsible for ensuring that the information provided when ordering is accurate and complete.
4. USE OF OUR WEBSITE
We grant users a limited, revocable, non-exclusive and non-transferable right to access and use this website for lawful personal shopping and informational purposes.
You may not use the website:
• for any unlawful or fraudulent purpose;
• to interfere with or disrupt the operation of the website;
• to introduce malicious software, viruses or harmful code;
• to gain unauthorised access to our systems or accounts;
• to impersonate The Morning Shuffle or another person;
• to misrepresent an affiliation with The Morning Shuffle;
• to harvest customer or business information;
• to interfere with website security;
• to conduct automated scraping or systematic data extraction without our written permission;
• to copy our product catalogue for commercial use;
• to reproduce our website for the purpose of creating a competing store;
• to use automated systems to place fraudulent or abusive orders; or
• otherwise in a manner that infringes our rights or the rights of another person.
We reserve the right to suspend or restrict access to the website where reasonably necessary to protect our business, customers, systems or legal rights.
5. OUR BRAND AND INTELLECTUAL PROPERTY
The Morning Shuffle brand is an important commercial asset of The Morning Shuffle (Pty) Ltd.
All rights in content appearing on this website that is owned by or licensed to us are reserved.
This includes, where applicable:
• The Morning Shuffle name;
• The Morning Shuffle logos;
• “Beyond the Horizon” branding;
• brand artwork;
• graphics;
• photographs;
• videos;
• product presentation;
• written product descriptions;
• promotional material;
• website copy;
• page designs;
• illustrations;
• icons;
• packaging designs;
• advertising concepts;
• social-media material;
• databases;
• compilations;
• website code owned by or licensed to us; and
• other creative or proprietary material.
The fact that material is publicly visible on our website or social-media pages does not grant any person the right to commercially reproduce, distribute, exploit or appropriate it.
Nothing on this website grants any licence to use The Morning Shuffle's intellectual property except the limited personal-use permission expressly contained in these Terms.
6. PROHIBITED USE OF THE MORNING SHUFFLE BRAND
Unless we have provided prior written consent, you may not:
• use The Morning Shuffle name or logo in your business name;
• manufacture or sell counterfeit Morning Shuffle products;
• copy our branding in a manner likely to cause confusion;
• represent yourself as an authorised agent, distributor, reseller, franchisee, partner or representative of The Morning Shuffle;
• establish a website, domain, social-media account or marketplace profile that falsely appears to belong to or be endorsed by The Morning Shuffle;
• remove, obscure or alter our branding from our original material for the purpose of falsely representing the material as your own;
• commercially reproduce our advertising;
• use our photographs or videos to market unrelated products;
• copy substantial portions of our product descriptions for a competing business;
• reproduce the structure or presentation of our store for commercial imitation;
• use our brand to create false endorsements; or
• otherwise use our proprietary material in a manner that infringes rights available to us under applicable law.
We reserve all legal rights and remedies available to us in respect of infringement, passing off, unlawful competition, copyright infringement, trade-mark infringement where applicable, misrepresentation or other unlawful use of our brand.
7. AUTOMATED SCRAPING, DATA MINING AND AI USE
Except where expressly permitted by law or authorised by us in writing, commercial automated extraction of content from our website is prohibited.
You may not use our proprietary website content, product descriptions, photographs, branding, original graphics or other protected material for:
• systematic web scraping;
• commercial data harvesting;
• creation of a competing product database;
• commercial dataset compilation;
• automated reproduction of our catalogue;
• training or fine-tuning a commercial artificial-intelligence model;
• populating a commercial generative-AI dataset; or
• creating substantially replicated commercial content.
Ordinary indexing by legitimate search engines is not prohibited by this clause.
8. PRODUCT INFORMATION
We endeavour to describe and display our products accurately.
However, colours and visual appearance may vary slightly depending on:
• screen settings;
• lighting;
• photography;
• device type;
• supplier manufacturing variations; and
• production batches.
Images are generally provided for illustrative purposes and must be read together with the written product description.
Where an exact colour, specification, capacity, size or other characteristic is material to your purchasing decision, please review the relevant product information before ordering or contact us for clarification.
Nothing in this provision permits misleading marketing or inaccurate representations prohibited by law.
9. PRODUCT AVAILABILITY
All products are subject to availability.
Displaying a product on our website does not guarantee perpetual availability.
Where goods become unavailable after an order has been submitted, we will deal with the order and any payment received in accordance with applicable law.
We may discontinue products or product variations from time to time.
10. ORDERS
Submitting an order represents a request to purchase the selected goods on the terms displayed at checkout and in these Terms.
Receipt of an automated order acknowledgement confirms that our system has received the order.
Subject to applicable law, we may decline or cancel an order before completion where there is a legitimate reason, including:
• stock unavailability;
• a genuine and obvious pricing or listing error;
• suspected fraud;
• unauthorised payment;
• inability to verify information reasonably required to fulfil the order;
• legal restrictions;
• an incorrectly configured product;
• duplicate transactions caused by an obvious technical error; or
• another lawful reason preventing fulfilment.
Where payment has already been collected for an order that we lawfully cancel, the amount due to the customer will be refunded.
We will not use this provision to arbitrarily deprive a consumer of rights granted by law.
11. ORDER INFORMATION
The customer is responsible for checking the order before completing checkout.
This includes confirming:
• the correct product;
• selected variant;
• quantity;
• delivery address;
• contact number;
• email address; and
• other information requested during checkout.
Customers should contact us immediately if they discover an error.
We cannot guarantee that an order can be changed once processing or dispatch has begun.
12. PRICES
Prices displayed on our website are expressed in South African Rand unless otherwise indicated.
The total price payable will be displayed during checkout together with applicable delivery charges and other disclosed costs.
We reserve the right to change prices prospectively.
A later price change does not retrospectively alter a completed transaction.
If a genuine and obvious pricing error occurs, we will address it in accordance with applicable South African law and will not use a pricing-error clause to defeat statutory consumer rights.
13. PROMOTIONS AND DISCOUNT CODES
Promotions may be subject to additional terms displayed with the promotion.
Unless otherwise stated:
• discount codes cannot be exchanged for cash;
• discount codes may have expiry dates;
• promotions may apply only to specified products;
• one promotion may not necessarily be combined with another;
• promotional stock may be limited; and
• fraudulent or unauthorised use of promotional codes may result in cancellation of the discount.
Any promotion will remain subject to applicable consumer law.
14. PAYMENT
Payment must be made using one of the payment methods made available at checkout.
Payments may be processed by third-party payment providers.
The Morning Shuffle does not control the internal processing systems, banking networks or security procedures of independent payment providers.
Customers are responsible for ensuring that they are authorised to use the payment method supplied.
We reserve the right to investigate transactions reasonably suspected of fraud, chargeback abuse, stolen payment credentials or other unlawful activity.
15. FRAUD PREVENTION
To protect customers and The Morning Shuffle, we may take reasonable steps to verify suspicious transactions.
This may include requesting reasonable verification relating to:
• customer identity;
• billing information;
• delivery details;
• order information; or
• payment authorisation.
We will process personal information for such purposes only to the extent permitted by applicable law.
We may decline or cancel a transaction where there are reasonable grounds to suspect fraud or unlawful conduct, subject to applicable law.
16. SHIPPING AND DELIVERY
Our standard nationwide delivery charge is:
R100.
Orders exceeding R1,200 qualify for free delivery where the offer remains displayed and applicable at checkout.
Our standard fulfilment information currently provides for approximately:
8–12 business days.
Delivery is generally undertaken through Aramex or another delivery provider selected by us.
Delivery periods are estimates unless a specific date has expressly been agreed.
Public holidays, extraordinary courier disruptions, severe weather, remote-area delivery requirements or circumstances beyond reasonable control may affect delivery times.
Nothing in this provision limits any statutory right arising from failure to deliver within a legally required or agreed period.

17. DELIVERY ADDRESS
Customers must provide a complete and accurate delivery address.
Where additional costs are reasonably incurred because the customer:
• supplied an incorrect address;
• supplied an incomplete address;
• gave an incorrect telephone number;
• failed to make themselves reasonably available for delivery; or
• failed to collect a parcel,
reasonable additional charges may be recovered to the extent permitted by law.
The customer remains protected where a delivery problem was caused by The Morning Shuffle or where applicable law places responsibility on us.
18. RETURNS, CANCELLATIONS AND REFUNDS
Returns, refunds and cancellations are governed by our separate Return, Refund & Cancellation Policy.
That policy forms part of these Terms.
Nothing in these Terms overrides:
• applicable ECTA cooling-off rights;
• CPA rights relating to defective goods;
• statutory warranties;
• rights concerning incorrectly supplied goods; or
• other mandatory consumer rights.

19. STATUTORY WARRANTY
Nothing in these Terms excludes the statutory implied warranty of quality provided by the CPA where the Act applies.
Qualifying defective, failed, unsafe or non-compliant goods remain subject to the rights and remedies provided by South African law.
The Morning Shuffle does not seek to contract out of those obligations.
20. IMPORTANT SPORT AND OUTDOOR ACTIVITY NOTICE
PLEASE READ THIS SECTION CAREFULLY.
Some products sold by The Morning Shuffle are intended for use in running, cycling, hiking, training, camping, travel and other physical or outdoor activities.
Those activities may carry inherent risks.
Purchasing equipment from The Morning Shuffle does not mean that:
• an activity becomes risk-free;
• injury cannot occur;
• equipment removes the need for appropriate judgment;
• equipment replaces professional instruction;
• equipment replaces appropriate medical care;
• equipment replaces legally required protective equipment; or
• every product is appropriate for every individual or situation.
Customers remain responsible for using products appropriately, following relevant instructions and selecting appropriate equipment for the activity concerned.
This provision does not exclude liability which cannot lawfully be excluded under the CPA or any other applicable legislation.
21. SPECIFIC PRODUCT SAFETY WARNINGS
Where applicable:
Carabiners
Carabiners marketed by us as general accessory products must not be used for climbing, fall arrest, life support or other safety-critical purposes unless the particular product is expressly represented and appropriately certified for that use.
Water Filtration Products
Water filters must be used according to the relevant product or supplier instructions.
No portable filtration device should automatically be assumed to make every possible water source safe for consumption.
Wound Closure Products
Emergency wound closure strips are intended for minor superficial wounds only.
They are not a substitute for professional medical treatment for serious, deep, contaminated, infected or heavily bleeding wounds.
Repair Patches
TPU repair patches are intended for minor repairs on compatible materials.
They must not be used as a substitute for a structural, load-bearing or safety-critical repair.
Reusable Cooling Products
Reusable cooling packs are not for consumption.
They should be kept away from sharp objects and used in accordance with supplied instructions.
Cycling and Running Equipment
Visibility accessories, lights or reflective products do not guarantee that a user will be seen by road users and do not replace compliance with road-safety laws, appropriate lighting or safe conduct.
22. IMPORTANT LIMITATION OF LIABILITY
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY ONLY TO THE EXTENT PERMITTED BY SOUTH AFRICAN LAW.
To the maximum extent lawfully permitted, The Morning Shuffle will not be liable for indirect, incidental or consequential loss resulting solely from:
• misuse of a product;
• use contrary to instructions or warnings;
• unauthorised modification;
• use of a product for an unintended purpose;
• negligence by the user;
• failure to use suitable safety equipment;
• reliance on a product as a substitute for professional medical, technical or safety advice; or
• circumstances beyond the reasonable control of The Morning Shuffle.
Nothing in these Terms:
• excludes or limits liability for gross negligence where such exclusion is prohibited;
• excludes rights relating to defective or unsafe goods where the CPA provides otherwise;
• excludes liability imposed by section 61 of the CPA where applicable;
• excludes liability for fraudulent conduct;
• limits any statutory remedy that cannot lawfully be limited; or
• requires a consumer to waive a non-waivable statutory right.
23. INDEMNITY FOR UNLAWFUL OR IMPROPER USE
TO THE EXTENT PERMITTED BY LAW, YOU AGREE TO INDEMNIFY THE MORNING SHUFFLE AGAINST CLAIMS, LOSSES OR REASONABLE COSTS ARISING DIRECTLY FROM YOUR OWN:
• unlawful use of the website;
• fraudulent conduct;
• infringement of another person's intellectual property;
• deliberate interference with our website or systems;
• unauthorised commercial use of our brand or content; or
• material breach of these Terms.
This indemnity does not apply to loss caused by conduct for which The Morning Shuffle may not lawfully exclude or shift liability.
24. PRODUCT LIABILITY
Nothing in these Terms excludes any liability that may arise under section 61 of the CPA in respect of qualifying harm caused by unsafe goods, product failures, defects, hazards or legally inadequate warnings.
The Morning Shuffle reserves the right to rely upon any statutory defence or limitation legitimately available under applicable law.
25. THIRD-PARTY PRODUCTS AND SERVICES
Our store may contain:
• third-party payment systems;
• courier services;
• embedded applications;
• external links;
• social-media links; or
• other third-party services.
Those services may be subject to separate terms and privacy practices.
We are not responsible for the independent content or operation of a third-party website merely because we provide a link to it.
This provision does not avoid responsibility where South African law makes us responsible for a particular act, omission, product or service.
26. WEBSITE AVAILABILITY
We endeavour to maintain reliable website access but do not guarantee uninterrupted availability.
The website may occasionally be unavailable because of:
• maintenance;
• Shopify platform interruptions;
• payment-provider interruptions;
• security measures;
• software updates;
• network failures; or
• circumstances outside our reasonable control.
We may modify, maintain or update the website where reasonably necessary.
27. WEBSITE SECURITY
You may not:
• attempt to bypass security measures;
• access another customer's account;
• interfere with website functionality;
• probe or test system vulnerabilities without authorisation;
• introduce malware;
• launch denial-of-service attacks; or
• access non-public systems without permission.
We reserve all rights to take appropriate technical and legal action against malicious activity.
28. CUSTOMER ACCOUNTS
Where customer accounts are available, the customer is responsible for maintaining the confidentiality of their account credentials.
You should notify us promptly if you reasonably believe that your account has been compromised.
You may not use another person's account without authorisation.
We may suspend an account where reasonably necessary to address fraud, abuse, security threats or material breaches of these Terms.
29. PERSONAL INFORMATION
We process personal information in accordance with applicable South African privacy law and our Privacy Policy.
Personal information may be processed where reasonably necessary for purposes including:
• completing transactions;
• processing payments;
• fulfilling orders;
• delivering products;
• communicating with customers;
• preventing fraud;
• administering accounts;
• complying with legal obligations; and
• other lawful business purposes described in our Privacy Policy.
We will take appropriate measures required by law to safeguard personal information.
Our Privacy Policy should be read together with these Terms.
POPIA establishes conditions including accountability, processing limitation, purpose specification, openness, security safeguards and data-subject participation.
30. REVIEWS, PHOTOGRAPHS AND CUSTOMER SUBMISSIONS
If you voluntarily submit a review, photograph, testimonial, video or other material to The Morning Shuffle for publication, you confirm that:
• you have the right to submit that material;
• it does not unlawfully infringe another person's rights;
• it is not knowingly false or defamatory; and
• its submission does not violate applicable law.
Where you expressly submit content for publication or promotional use, you grant The Morning Shuffle a non-exclusive, royalty-free licence to reproduce, display and use that submitted material for the purpose for which it was supplied, subject to applicable privacy and consumer law.
We will not claim ownership of a customer's underlying intellectual property merely because the customer submits content to us.
31. SOCIAL MEDIA
The Morning Shuffle may operate profiles on social-media platforms.
Social-media platforms are independently operated services and may have their own terms.
No third-party account may present itself as the official The Morning Shuffle account without our authority.
Unauthorised impersonation, fraudulent accounts or misleading use of our brand may be reported to the relevant platform and dealt with using any available legal remedies.
32. COMMERCIAL RESELLERS
Purchasing a genuine product does not by itself authorise a person to represent themselves as:
• an official reseller;
• authorised stockist;
• distributor;
• franchisee;
• brand partner; or
• representative of The Morning Shuffle.
Any formal commercial relationship requires written authorisation from The Morning Shuffle.
Nothing in this provision is intended to prohibit a lawful resale right that cannot legally be restricted.
33. COUNTERFEIT GOODS AND BRAND IMPERSONATION
We reserve all rights in relation to persons who manufacture, advertise or sell counterfeit products bearing our protected branding or who otherwise unlawfully imitate our brand.
Where appropriate, we may:
• report counterfeit listings to marketplaces;
• report impersonating accounts to platforms;
• issue takedown requests;
• send formal demands;
• enforce intellectual-property rights;
• pursue passing-off or unlawful-competition remedies; or
• take other lawful action.
34. FORCE MAJEURE AND EVENTS OUTSIDE REASONABLE CONTROL
To the extent permitted by law, The Morning Shuffle will not be responsible for delay caused by circumstances genuinely outside its reasonable control.
Examples may include:
• natural disasters;
• severe weather;
• widespread power or telecommunications failures;
• civil unrest;
• governmental restrictions;
• transport-network disruption;
• strikes beyond our reasonable control;
• major courier-system failures;
• border or customs disruption; or
• other exceptional events preventing performance.
This clause does not remove any statutory cancellation, refund or delivery right arising under applicable law.
35. COMPLAINTS
We encourage customers to contact us first so that we can attempt to resolve legitimate concerns promptly.

Nothing in these Terms prevents a consumer from approaching an appropriate court, regulator, consumer tribunal, ombud or other body where permitted by law.
36. NO WAIVER OF RIGHTS
If The Morning Shuffle does not immediately enforce a provision of these Terms, this does not automatically constitute a permanent waiver of that provision or of our rights.
Any waiver applies only to the extent expressly communicated.
37. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed or limited to the minimum extent necessary.
The remaining provisions will continue to apply to the extent permitted by law.
38. ENTIRE AGREEMENT
These Terms, together with policies expressly incorporated into them, constitute the terms governing transactions through our online store, subject always to:
• mandatory legislation;
• representations that legally form part of the transaction; and
• any express agreement made with the customer.
Nothing in this clause excludes liability for a representation that cannot lawfully be excluded.
39. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect:
• changes to our business;
• website functionality;
• products;
• delivery processes;
• security requirements; or
• applicable law.
Changes apply prospectively from the date on which updated Terms are published unless applicable law provides otherwise.
We will not retrospectively remove rights that already accrued to a customer under an existing transaction.
40. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with subject to:
• applicable consumer legislation;
• any jurisdiction granted to a consumer by law; and
• the jurisdiction of any competent court, regulator, tribunal, ombud or other authorised dispute-resolution body.
Nothing in these Terms requires a consumer to surrender a statutory right to approach a competent forum.

42. ACCEPTANCE OF TERMS
By placing an order through www.themorningshufflesa.co.za, the customer confirms that they have had an opportunity to access these Terms before completing the transaction.
Acceptance of these Terms does not amount to a waiver of any statutory consumer right.
